The US Department of Health and Human Services (HHS) admitted in a federal court stipulation signed on July 6, 2018 that it never submitted biannual reports to Congress detailing improvements in vaccine safety made by HHS as required by the 1986 National Childhood Vaccine Injury Act (NCVIA) at 42 U.S.C Sec. 300aa-27(c). The first report was due in 1989, and was supposed to be followed with reports every two years. The admission was contained in a document concluding a lawsuit filed by the Informed Consent Action Network to compel HHS to produce the requested (non-existent) documents. The Informed Consent Action Network was represented by Robert F. Kennedy, Jr.

The National Childhood Vaccine Injury Act granted vaccine manufacturers and physicians complete legal immunity from any injury caused by a vaccine. People injured by vaccines had their right to sue in court taken away. That basic Constitutional right was replaced with in an administrative procedure usually called the “vaccine court.” Fundamental rights that are the foundation of American law do not apply in the “vaccine court.” Injured parties have no right to subpoena witnesses. They have no right to discovery, the crucial right to compel drug companies and the government agencies to reveal documents. Lawyers are paid for by the government, not the “client.” Cases are heard by “special masters” not judges. Juries are not allowed. Damages in the rare instance where the government admits a death occurred are limited to $250,000. Originally, the law allowed people to go to a real court after completing the “vaccine court”, but that right was severely curtailed by the US Supreme Court in Brusewitz v. Wyeth.
In exchange for this shocking loss of basic rights, the American people were supposed to receive a system that produced better and safer vaccines, what we got is deliberate institutional neglect. “This speaks volumes to the lack of seriousness by which vaccine safety is treated at HHS and heightens the concern that HHS doesn’t have a clue as to the actual safety profile of the now 29 doses, and growing, of vaccines given by one year of age,” said Kennedy in a statement from the World Mercury Project.
