SB 277 signed into Law and is EFFECTIVE July 1, 2016
Governor Brown signed SB 277 the most stringent vaccine mandate in the United States on June 30, 2015. If not repealed this new law will go into effect on July 1, 2016.
Families that do not comply with the one-size-fits-all vaccine mandate, will lose their State Constitutional right for a free and appropriate education in public and private K-12 schools. The use of licensed daycare facilities, in-home daycare, public or private preschools and even after school care programs are also included in SB 277. School aged children, not up-to-date on every mandated vaccine, will be required to home school without options for classroom learning. SB 277 eliminates a parent’s right to exempt their children from one, some, or all vaccines, a risk-laden medical procedure including death. In 2016, California parents will be forced to give their children more than 40 doses of 10 federally recommended vaccines. This open-ended vaccine mandate allows the State of California to add any additional vaccines they deem necessary at anytime. The only exemption available is a medical exemption that doctors deny to 99.99 percent of children under federal guidelines. July 1, 2015 A personal belief exemption (PBE) is still the law of the state and is valid for a private or public elementary or secondary school, child day care center, day nursery, nursery school, family day care home, or development center until July1, 2016. Your PBE must be submitted to your school by July 1, 2016 for the 2015-16 school year. Please note: PBEs were not required before January 2014. The daycare and school aged PBE form will need to be signed off by a doctor before July 1, 2016. In their letter of July 2, 2015 the State of California—Health and Human Services Agency California Department of Public confirmed that SB277 is not effective until July 1 2016. A PBE is valid until your child advances to the next “grade span” or in other words, until they move up to the next school or changes school. The law states that a grade span is:
So, for example, if your child is starting kindergarten in the fall of 2015 with a PBE, no further vaccines will be required and no other exemption will be asked for until 7th grade. However, when this child enters 7th grade then all the required vaccines must be up to date.
The bill also states that if more vaccines are added later to this above required list a PBE would be permitted for these new vaccines. Exemptions will be available for medical reasons. The bill states: These are some of the situations in which a medical exemption may be warranted:
Unfortunately, doctors cannot give a medical exemption because a parent believes that vaccines are generally unsafe and might harm their child. This is what we understand the situation to be thus far. We will continue to study the law and update as needed. |
